Please read these Terms and Conditions (“Terms”) carefully before using the thecreekretreats.com website (the “Service”) operated by Topa View Property (“I,” “me,” or “my”). By booking a stay or using this website, you agree to be bound by these Terms.
1. Reservations and Booking
Payment Policy: Full payment must be received and cleared at least 24 hours prior to check-in. I accept payments via Zelle, Direct Deposit, or Check.
- Check Payments: Must be received at least seven (7) business days prior to arrival. Reservations made within 7 days of arrival must be paid via Zelle or Direct Deposit.
- Insufficient Funds: Returned checks result in immediate cancellation and bank fees billed to the guest.
- Booking Integrity: I do not allow third-party bookings or subletting. The guest of record must be present for the entire stay.
2. Check-In / Check-Out
Check-In: 03:00 PM. I will do my best to accommodate early arrivals, but this must be requested at least 24 hours in advance and is subject to availability.
Check-Out: 10:00 AM. Timely check-out is essential for my cleaning staff. Unauthorized late check-outs may incur a fee of $50 per hour.
3. Property Specific Rules
- Prohibited Uses: Residential vacation use only. Commercial filming, professional photography, parties, and large gatherings are strictly prohibited without my prior written consent. Unauthorized commercial activity will result in immediate termination of the stay without refund.
- Zero Tolerance Policy: Illegal activity, including the use of illegal substances, is strictly prohibited on the premises. Violations will result in immediate eviction without refund.
- Smoking & Pets: Smoke-free and pet-free property unless specified in writing. Violations result in a $500 deep-cleaning fee.
4. Property Care and Conduct
Good Neighbor Policy: Quiet hours are 10:00 PM to 08:00 AM. Disruptive behavior results in immediate eviction without refund.
Maintenance: Guests agree to keep the property in good repair and report issues immediately. Tampering with, disconnecting, or obscuring smoke detectors, carbon monoxide alarms, or exterior security cameras is strictly prohibited and results in immediate eviction.
Cleaning: Excessive cleaning beyond standard turnover billed at $75/hour. Lost items can be returned at guest’s expense plus a $25 handling fee.
5. Liability and Damages
Hold Harmless: I am not responsible for accidents, injuries, or illnesses on the premises. Guests assume all risk and agree to indemnify me from any claims.
Environmental Risks: Guests at Mountain, Surf, and Nature retreats acknowledge risks including uneven terrain, local wildlife, changing tides, ocean currents, and unpredictable weather. Use of the property and its natural areas is strictly at your own risk.
Damage & Loss of Use: Guests are 100% financially responsible for damage to the property or furniture. If damage renders the property unrentable for future guests, you are responsible for the full cost of repairs plus the lost revenue for the duration the property remains offline.
6. Property Usage & Occupancy Limits
* Any vehicle parked in violation of these rules or local ordinances is subject to towing at the guest's expense. I am not responsible for damage to or theft from vehicles.
7. Acts of God & Force Majeure
I am not liable for events outside my control (wildfires, air quality, storms, power outages). Liability is limited to a refund of the unused portion of the stay during mandatory evacuations. I am not responsible for secondary travel costs or "disappointment" due to weather.
8. Governing Law
These Terms are governed by the laws of California. Any legal action shall be instituted exclusively in a state or federal court located in Ventura County, California.
